Elizabeth Warren may face consequences for practicing censorship

Elizabeth Warren, a mediocre law professor who parlayed a fake Native American identity into a gig at Harvard and a seat in the United States Senate, thought that, once in government, she’d try her hand at censorship. When Joseph Mercola and Ronnie Cummins wrote a book about COVID with which Warren disagreed, she used her position as a Senator to try to get Amazon to censor the book. Although Chelsea Green Publishing filed suit in November, people are finally becoming aware of the suit.

I’m always amazed when someone who ought to know the law doesn’t—or feels entitled to ignore it. As a lawyer and a law professor, one would expect Warren to be familiar with the First Amendment. That’s the one that says that “Congress shall make no law…abridging the freedom of speech.” As government has grown, that principle has been extended to the federal government as a whole, whether it’s an executive agency, Congress, or a politician acting under the color of his or her role in the government. (And of course, to state governments via the Fourteenth Amendment.)

Nevertheless, on September 7, 2021, writing in her capacity as a United States Senator, on official Senate letterhead, Warren sent a very long letter to Andy Jassy, Amazon’s CEO, expressing her concern that Amazon itself was publishing misinformation by allowing Mercola’s and Cummins’s book, The Truth About COVID-19: Exposing the Great Reset, Lockdowns, Vaccine Passports, and the New Normal, to appear on its bestseller list and daring to give it a favorable ranking. After waffling on for pages several pages, and mendaciously claiming the book was “potentially unlawful,” Warren “asked” Amazon to modify the algorithms to destroy the book’s ranking.

Chelsea Green responded in November by suing Warren for violating the First Amendment, although news of that filing only reached the media recently. The lawsuit relies upon Bantam Books, Inc. v. Sullivan, 372 U.S. 58 (1962). Bantam Books involved a newly-created Rhode Island Commission which had the task of educating the public about any written material that could harm the morality of or otherwise corrupt Rhode Island’s young people. In Bantam Books, the plaintiff publishers sued, alleging that the commission was violating their First Amendment rights. The Court held, in relevant part, that government representatives sending letters to booksellers to pull books constitutes a form of censorship that violates the Constitution.

Specifically, the government cannot relieve itself of the First Amendment’s prohibitions by urging a private party to act on its behalf. In the same way, when Biden told social media companies to censor views with which he disagrees, that too violated the Constitution. The only thing is that he was just telling the media companies to do what they’re already doing.

In the original November 8, 2021, press release about the lawsuit, Chelsea Green had this to say:

Plaintiffs allege Warren’s letter contained blatant falsehoods and unsubstantiated accusations about the book and that Warren’s claims, even if correct, would not alter the book’s constitutional protectedness.

“Senator Warren broke the law and betrayed our fundamental right to free speech,” said Dr. Joseph Mercola, founder of Mercola.com, a natural health website. “No politician is above the law, I will do everything in my power to defend my constitutional rights as an American.”

Ronnie Cummins, co-founder of the Organic Consumers Association, said: “Constitutionally guaranteed freedom of speech is necessary if we are to achieve a system of participatory democracy and solve the interrelated crises that threaten our survival — health, food, environment, climate, politics.”

“The government trying to ban books is a very dangerous slippery slope to totalitarianism and cannot be allowed,” said Margo Baldwin, Chelsea Green president and publisher.

Robert F. Kennedy, Jr., chairman, Children’s Health Defense, said: “If a government can hide what it’s doing by censoring its opponents and silencing dissonants, it has license to do anything that it wants. Sen. Warren must be held accountable.”

I wish Chelsea Green luck. Like all leftists, Warren is a bully and it’s high time that she was seriously reprimanded for her bullying ways. I’m only sorry that the lawsuit cannot include a request for compensatory and punitive damages.

Amazon Issued an Alarming Statement on Their Ban Book
Amazon finally gave a public reason why they removed Ryan T. Anderson’s book When Harry Became Sally from their online store after many of you signed NTC’s petition (and a few U.S. Senators demanded answers). Amazon’s response was that they are removing all books that classify transgender identity as a mental illness. 

Anderson’s book, however, does not classify transgender identity as a mental illness, so Amazon is already violating its own standards. This is especially concerning since there is active legislation about how transgender issues will be handled under the law. The world’s largest bookseller is zealously silencing one side of the debate at the most critical moment. This can only be bad for our democracy.

Amazon did not inform the author or publisher of its decision, and other books by Anderson are still for sale on Amazon as are books by other authors that take a similar stance on transgenderism. Amazon’s actions suggest that it has adopted an ominous new “woke” censorship approach where certain books suddenly become problematic and disappear. Others – like “Mein Kampf” – remain openly for sale, with no discernable universal standard. Parler sues Amazon, asks court to reinstate platform

Social media company Parler sued Amazon on Monday, alleging that its suspension from Amazon’s hosting service violated antitrust law and breached the companies’ contractual arrangement.

In its lawsuit, Parler, which is especially popular among conservatives, asked a federal judge to order that the platform be reinstated online.

The 18-page complaint, filed in U.S. District Court in Seattle, where Amazon is headquartered, accuses Amazon Web Services (AWS) of applying a politically motivated double standard to Parler in contrast to its treatment of the more mainstream social media giant Twitter.

“AWS’s decision to effectively terminate Parler’s account is apparently motivated by political animus,” the lawsuit reads. “It is also apparently designed to reduce competition in the microblogging services market to the benefit of Twitter.”

Multiple legal experts told The Hill that Parler’s antitrust claim was unlikely to succeed. The lawsuit does not establish that Parler’s suspension was part of an agreement between Amazon and Twitter, the rival social media company that Parler identified as the beneficiary of its shutdown.

“On the antitrust side, it’s pretty weak,” said Erik Hovenkamp, a law professor at the University of Southern California. “The biggest flaw in the complaint by far is really just that it doesn’t allege facts that would indicate a conspiracy between Amazon and Twitter.”

The lawsuit comes a day after Amazon suspended Parler, citing concerns it could not adequately screen out potentially incendiary content, including material that incites violence. It also follows Wednesday’s deadly, Trump-inspired insurrection at the U.S. Capitol that left five people dead.

The app saw a massive surge in users between the mob attack at the Capitol and when it was pulled down from Amazon Web Services.

Parler saw approximately 825,000 installs from the Apple and Google stores between Wednesday and Sunday, a more than 1,000 percent increase from the same period a week earlier, according to data from SensorTower shared with The Hill.

Parler told the court that its newfound popularity explained part of the urgency behind its emergency request to have its suspension reversed.

“It will kill Parler’s business — at the very time it is set to skyrocket,” the filing states.

In addition to its antitrust claim, Parler also alleged that Amazon breached their contract by not giving 30 days notice before terminating Parler’s account. 

However, Amazon told The Hill that it notified Parler over the past several weeks that numerous posts on its site had promoted violence, in violation of their agreed-upon terms. According to a letter obtained by BuzzFeed, Amazon informed Parler of 98 examples of content “that clearly encourage and incite violence” over that timeframe.

“We made our concerns known to Parler over a number of weeks and during that time we saw a significant increase in this type of dangerous content, not a decrease, which led to our suspension of their services Sunday evening,” an AWS spokesperson told The Hill.

However, Amazon reportedly notified Parler over the past several weeks that numerous posts on its site had promoted violence, in violation of their agreed-upon terms. According to a letter obtained by BuzzFeed, Amazon informed Parler of 98 examples of content “that clearly encourage and incite violence” over that timeframe.

David Hoffman, a law professor at the University of Pennsylvania, said it would severely undercut Parler’s breach of contract claim if in fact Amazon had warned the company repeatedly that it was playing host to offensive material.

“It’s not simply that there’s one day of bad posts,” Hoffman said, referring to Amazon’s letter. “There have been repeated warnings over time about Parler’s failure to comply with Amazon’s terms of use. Given those repeated warnings over time, it’s sort of rich to say, ‘You didn’t give us enough time.’”

Hoffman also noted that Amazon’s standard policy is to resolve web-hosting disputes through an arbitration process rather than in the courts, presenting another potential legal pitfall for Parler.   

Amazon’s suspension of Parler came after the Apple and Google app stores — essentially the only places for Americans to download mobile apps — decided over the weekend to stop carrying Parler.

The furor over the app stems from its role in facilitating last week’s violent riot at the Capitol. Trump supporters and right-wing extremists used the app, which has billed itself as a haven for free speech, to coordinate and incite the demonstrations ostensibly opposing the certification of President-elect Joe Biden’s victory.

Without access to Amazon Web Services, the app has been dark on Monday.

During this week’s broadcast of FNC’s “Sunday Morning Futures,” Rep. Devin Nunes (R-CA), the ranking Republican on the House Intelligence Committee, called on the Department of Justice to launch an investigation into tech companies’ efforts to remove Parler as a platform from the internet.

The California Republican cited violations of antitrust laws, civil rights and the Racketeer Influenced and Corrupt Organizations Act.

“Well, Maria, when I wrote that book, I was hoping to warn Americans so that they would vote right and that maybe this wouldn’t happen and this could be prevented,” he said. “Unfortunately, it’s far worse than what I could even imagine. The effect of this is that there is no longer a free and open social media company or site for any American to get on any longer, because these big companies, Apple, Amazon, Google, they have just destroyed a — what was likely — Parler is likely a billion-dollar company. Poof, it’s gone. But it’s more than just the financial aspect to that. Republicans have no way to communicate. If — and it doesn’t even matter if you’re a Republican or conservative.”

“If you don’t want to be regulated by left-wingers that are at Twitter and Facebook and Instagram, where you get shadowbanned, nobody gets to see you — nobody gets to see you, they get to decide what’s violent or not violent, it’s preposterous,” Nunes continued. “So, I don’t know where the hell the Department of Justice is at right now or the FBI. This is clearly a violation of antitrust, civil rights, the RICO statute. There should be a racketeering investigation on all the people that coordinated this attack on not only a company but on all of those like us, like me, like you, Maria. I have 3 million followers on Parler. Tonight, I will no longer be able to communicate with those people. And they’re Americans.”

The Ontario Civil Liberties Association has received documentation from Ontario lawyer Aaron Rosenberg showing that Amazon interfered with and repeatedly deplatformed his client’s book.

The book is “China Virus: How Justin Trudeau’s Pro-Communist Ideology is Putting Canadians in danger”, by Ezra Levant of Rebel News.

Amazon is enabled by State corporate laws to in-effect operate as a book publishing monopoly.

Amazon benefits from corporate law by tax advantages and by shielding its executives and board members from personal liability.

Amazon occupies the internet, thus using internet facilities that have been largely created with public money. The internet is a publicly-funded shared resource, from landlines following rail and road networks, to university hubs, and so on. The very architecture of the internet is from publicly-funded intellectual efforts.

Corporations, such as Amazon, are free to be independent in their corporate strategy and functioning. However, non-specialized monopolistic online publishers and social media giants, because of their fundamental and government-enabled societal role in giving individuals a voice to participate in democracy and to express themselves freely, with equal access, should not violate the constitutional, Charter, democratic, political, and natural freedom-of-expression rights of authors and readers, arbitrarily or by contract.

Blocking YouTube channels and banning books on Amazon are akin to requiring government authorisation to operate a printing press or to buy a photocopier or pen and paper. Only the technology and the administrative covering structures have changed. Establishment censorship is establishment censorship.

Amazon is applying the correct principle of free expression in publishing the historically influential works of Mao, Hitler, Che Guevara, Karl Marx, Errico Malatesta, Adam Smith, and many others, but it is applying outright censorship against current works that it deems threatens the dominant establishment projects of the moment.

OCLA has noticed an aggressive censorship of influential works that potentially threaten the current global state of medical totalitarianism. “Public health risk” is being wielded as a ready-made pretext for deplatforming and censorship. This is obscene. There must be free expression, whether establishment structures have declared a pandemic or not. There must especially be free expression when the government is enacting draconian measures, such as a global lockdown and forcing individuals to wear masks, no less. Everyone must have a voice. Everyone is impacted by unprecedented (we argue reckless[1]) government actions.

It appears that Ezra Levant’s book may have been captured by the medical totalitarian net. Whatever the actual reasons for Amazon’s egregious violation of Mr. Levant’s free expression, and of the rights of his readers, the actions of Amazon are wrong and harmful to society.

On Feb. 17 at the United Center in Chicago, before a cheering crowd of black Muslims numbered in the thousands — and who knows how many viewing around the world via webcast — this writer lauded the Nation of Islam’s three volume The Secret Relationship Between Blacks and Jews as “magisterial revisionist history.”  
 
Nine days later, on February 26, after having been offered for sale on Amazon for several years, these three books were suddenly banned for “violating content guidelines,” an apparent euphemism for offending the Holy People. Coincidence?
 
Until such time as alternatives to Amazon (and independent libertarian platforms for podcasting) are created, the Tech Tyranny, as Ron Unz indicates (see below), will march on amid the stark media silence concerning the censorship of history books which Zionists and Talmudists detest. This is indeed a sinister Orwellian state of affairs. Public exposure of the censorship and the hypocrisy that informs it, is essential for the survival of freedom.
 
Jeff Bezos, who founded and owns a controlling stake in Amazon, also owns the Washington Post whose motto, flaunted in a virtue-signaling 2019 Superbowl commercial, is “Democracy Dies in Darkness” — the same darkness in which the Nation of Islam’s documented history of Judaic control of the black slave trade in the western hemisphere, has been consigned.

During the 2016 presidential race, it was widely anticipated that Hillary Clinton and Jeb Bush would be the contending nominees, fiercely battling each other on hot-button partisan issues while quietly standing together on War, Peace, and the Economy. Such a race would surely have been soporific and vacuous to the vast majority of the general public. The sudden and totally unexpected populist rise of both Bernie Sanders and Donald Trump fractured this projected narrative, and Trump’s election shredded it. 
 
Although the most extreme Neocon elements soon regained control over the foreign policy of the Trump Administration, America’s ruling ideological establishment was horrified by the close call they had suffered, and began an unprecedented attack upon the Internet and dissident publications and writers, with mass bannings, harsh censorship, and widespread “de-platforming.” The most utterly ridiculous accusations—suggesting that Ron Paul was a Russian agent of influence—soon began echoing within the corporate media, and many alternative websites were cowed into trimming their dissenting sails lest they suffer severe consequences.
 
Many critics were jubilant over the recent closure of The Weekly Standard, the Neocon organ most heavily responsible for the disastrous Iraq War, they have misunderstood the reality of the situation. With so many similar Neocon ideologues now firmly ensconced on the editorial pages of the New York Times, the Washington Post, and every other major newspaper, Bill Kristol’s former publication no longer had any real role to play. I think a case can be made that with the exception of a few zealous Trump partisans here and there, the establishmentarian American media landscape is more totally unified than it has been for decades, especially with regard to foreign policy issues, and dissenting voices never so unwelcome. 
 
When a country’s ruling elites are highly unified but fearful of maintaining their continuing power in the face of popular discontent, harsh crackdowns are a natural consequence, and America’s widely enshrined First Amendment liberties are now being increasingly circumvented on the Internet by utilizing the corporate monopolies that control that means of communication. 
 
During the 1950s, any proposal to ban suspected Communists from making telephone calls, watching television, or having bank accounts would have been ridiculed as utter lunacy, but in today’s America, equivalent actions are steadily growing more frequent and more severe. 
 
With so many vibrant alternative publications having been brought into line and so many once raucous comment sections now strictly policed by strict identity registration requirements or eliminated completely, our webzine (www.unz.com) has gradually become a much bigger fish in the rapidly shrinking pond of free thought on the Internet.
 
We shall see whether the angry flapping of our contributing writers achieves any result before the “Powers That Be” complete their total evaporation of all remaining intellectual freedom in the Western world.

Glenn Reynolds called on Trump on Monday to breakup the tech monopolies like his predecessor Teddy Roosevelt did back in the early 1900s.

RUSH: Glenn Harlan Reynolds, who’s a friend and a law professor at the University of Tennessee, has a column out today in USA Today saying that Trump has got… Forget prison or anything else. If Trump doesn’t get a handle on the monopolies that exist now — Facebook, Google, Netflix, and (What’s the other one?) Amazon, the social media titans — that if this not gotten handle on, we don’t have a prayer because they have monopolized social media, and in the process of monopolizing it and mass media, they are excluding anything and everybody conservative.
So Glenn’s piece today is suggesting that Trump needs to do his own version of Teddy Roosevelt and bust ’em up. Teddy Roosevelt busted up the trusts, among them Standard Oil, the Rockefeller family, and J. P. Morgan, who was on the verge (chuckles) of owning the United States financial markets. Do you know back in the late 1800s, early 1900s, when the federal government needed money, they went to J. P. Morgan to borrow it? Before there was a tax code, before there was a tax system, they went to J. P. Morgan to get money. Well, J. P. Morgan was one of the trusts that Teddy Roosevelt busted up.
I’ll tell you, Glenn Reynolds makes a pervasive case in this — and even if he hadn’t made it, it’s a scary thing. You know, I don’t like monopolies, and I really hate government intervention, but this social media stuff is getting totally out of hand, especially, folks… There’s now polling data. I forget where a term. I’ll find it just a second. It’s a credible polling unit. Do you know that 42% of the American people believe that the Russians meddled with votes in 2016? This has been one of the most successful hoaxes that has ever been run in politics.
This has been one of the most successful disinformation campaigns ever, the fact that the Russians and Trump colluded to steal the election. There isn’t any evidence! In fact, in announcing the latest series of indictments, Rod Rosenstein, the deputy attorney general, made it clear that in none of the indictment that Mueller has announced is there any allegation or evidence that a single vote was tampered with! Yet you read newspaper accounts of this or watch cable news accounts, they don’t even mention that that has been acknowledged and admitted by the government.
They continue with the myth that not only did Trump and the Russians collude, but the Russians tampered with vote totals. It did not happen, and yet 42% of the American people believe it largely because of the media — and social media, which is one of the biggest promotional groundswells for that point of view. You talk about misinformation and disinformation? This is profound. There is no evidence that any of this happened!

On Tuesday night, after the votes were counted, Democrats took control of the US House of Representatives.
Wealthy suburban voters and women are being credited for the win.
At least 35 Republican lawmakers lost their seats last Tuesday night.

Democrats have a huge advantage over Republicans with their partners in the media complex, Hollywood, and academia.

And, unlike 2016, this year Democrats can also can give a huge amount of credit to Tech giants Google, Facebook and Twitter.

Suburban voters and women no longer were reading conservative articles on Facebook.  Facebook eliminated at least 1.5 billion links to conservative articles since 2017.  If you add additional websites like The Gateway Pundit, Infowars, Young Cons, Right Wing News, etc. the number tops 2 billion easy.  And it likely made a difference on Tuesday night.  80% of women age 18-49 have Facebook accounts.  These are the women who get their news from Facebook.  Facebook knows this and eliminated conservative content on their platform so there would be no repeat of 2016.

It’s no secret that the Silicon Valley tech giants discriminate against conservatives and conservative content.
In August President Trump warned Google about it’s biased practices against conservatives and conservative content in their search feature.
Facebook has been shutting down traffic to conservative websites since the 2016 election.
The Gateway Pundit recently spoke with two of the top conservative publishers in America.
Floyd Brown is a conservative author, speaker and media commentator. In 2008 Floyd launched Western Journal which quickly became one of the top conservative websites in America. By 2016 Floyd’s organization of Western Journal and other conservative websites under his umbrella had more than a billion page views. Since 2016 Floyd’s organization lost 75% of its Facebook traffic.
Likewise, we spoke with Jared Vallorani from Klicked Media. Jared traveled to Washington DC with The Gateway Pundit and website owners at 100%FedUp in June to discuss Facebook targeting against conservative publishers with Republican lawmakers. Jared told The Gateway Pundit his organization Klicked Media, which hosts over 60 conservative websites, lost 400 million page views from Facebook in the last six months if you compare the traffic to a year ago.  Jared said, “We lost 70% to 80% of our traffic if you compare January to May 2017 vs Jan to May 2018.”

If you combine the total number of page-views lost by just these two conservative online publishers you are looking at a loss of over 1.5 billion page-views from Facebook in one year.

These are numbers from just two of the top conservative publishers in America.  This does not include the thousands of other conservative publishers across the country who lost all of their traffic coming from Facebook.  Here at The Gateway Pundit our Facebook traffic has been effectively eliminated after we were ranked as the 4th most influential conservative publisher in the 2016 election.
The fact that Facebook is targeting conservative publishers should not be a surprise to Gateway Pundit readers.
We have been reporting on this for several months now. In July we released a study where we looked at several top conservative websites and discovered that the publishers had lost an average of 93% of their Facebook traffic.
This is a bloodbath.  Facebook has wiped out conservative content to American subscribers.

In 2016 suburban voters and women would check their Facebook pages and get conservative news.  That is no longer the case.  And on Tuesday these voters chose Democrats.

Facebook has wiped out conservative publishers. Americans will no longer see articles from conservative websites even if you follow them. Facebook took advertising dollars from all of these businesses and then changed their business plan after the 2016 election.
Facebook wants to pretend this was not a political decision. Yet, several top liberal activist groups: Media Matters, Share Blue, CREW and American Bridge, made it a priority in early 2017 to work with the liberal tech giants to undermine President Trump and ensure that liberals gain control of Congress and the presidency in 2020.
The tech giants did just that.
