Photo by Getty Images<\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"><\/h2>\n\n\n\n<p>When I was a kid, we used to say that, \u201cSticks and stones may break my bones but words will never hurt.\u201d Nowadays, offensive speech is considered violence. Silence is violence. And those whose words are deemed by the state to be most egregious will be treated like serial killers.<\/p>\n\n\n\n<p>\u201cAll of us expect to be safe in our homes, in our neighbourhoods and in our communities,\u201d <a href=\"https:\/\/globalnews.ca\/news\/10317040\/online-harms-bill-canada\/\">said<\/a> Justice Minister Arif Virani, after tabling <a rel=\"noreferrer noopener\" href=\"https:\/\/www.parl.ca\/DocumentViewer\/en\/44-1\/bill\/C-63\/first-reading\" target=\"_blank\">Bill C-63<\/a>, the online harms act, in the House of Commons on Monday. \u201cWe should be able to expect the same kind of safety in our online communities.\u201d<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Except many Canadians don\u2019t feel safe in their communities anymore. Last summer, <a rel=\"noreferrer noopener\" href=\"https:\/\/www150.statcan.gc.ca\/n1\/daily-quotidien\/230727\/dq230727b-eng.htm\" target=\"_blank\">Statistics Canada reported<\/a> that the police-reported crime rate in 2022 had increased by five per cent compared to a year earlier. The homicide rate rose for the fourth consecutive year, reaching its highest level since 1992.<\/p>\n\n\n\n<p>Rather than focusing on the type of crime that puts Canadians\u2019 property and physical safety at risk \u2014 the \u201csticks and stones,\u201d if you will \u2014 the government has chosen to focus on the words being transmitted to our smartphones and laptops.<\/p>\n\n\n\n<p>To accomplish this, <a rel=\"noreferrer noopener\" href=\"https:\/\/nationalpost.com\/news\/politics\/liberals-harmful-online-content\" target=\"_blank\">the Liberals propose<\/a> burdening \u201csocial media\u201d platforms with heavy-handed regulations; creating a giant censorship bureaucracy to force compliance; and re-empowering kangaroo courts to persecute people for thought crimes.<\/p>\n\n\n\n<p>Bill C-63 establishes a new digital safety commission, digital safety ombudsperson and digital safety office (to assist the commission and ombudsman), which will be responsible for ensuring revenge porn and child pornography are taken offline within 24 hours. (Subscriber-exclusive edition on Fridays)<\/p>\n\n\n\n<p>By signing up you consent to receive the above newsletter from Postmedia Network Inc.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Websites will be responsible for ensuring they have tools that allow users to flag posts and systems in place to determine whether they meet the definition of \u201charmful content,\u201d which includes \u201ccontent that induces a child to harm themselves,\u201d \u201ccontent used to bully a child,\u201d \u201ccontent that foments hatred,\u201d \u201ccontent that incites violence\u201d and \u201ccontent that incites violent extremism or terrorism.\u201d<\/p>\n\n\n\n<p>While social media companies will be required to submit data on the volume of harmful content found on their sites to the new digital safety commission, enforcement will be punted to the courts and the human rights tribunal, where the penalties are much steeper than merely having a post arbitrarily deleted.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><a href=\"https:\/\/nationalpost.com\/opinion\/online-harms-bill-risks-surveillance-state\">e<\/a><\/p>\n\n\n\n<ol>\n<li><\/li>\n<\/ol>\n\n\n\n<p>The bill would reinstate parts of Section 13 of the Canadian Human Rights Act, which will once again put decisions over what constitutes online hate speech in the hands of the quasi-judicial Canadian Human Rights Commission (HRC) and the Canadian Human Rights Tribunal.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>It would also increase the penalty for anyone who \u201cadvocates or promotes genocide\u201d to a maximum of life in prison \u2014 the same sentence, it should be noted, as was handed to <a rel=\"noreferrer noopener\" href=\"https:\/\/en.wikipedia.org\/wiki\/Robert_Pickton\" target=\"_blank\">Robert Pickton<\/a>, one of Canada\u2019s most prolific serial killers and rapists. And it specifically prohibits website operators from notifying users when they have been reported to law enforcement.<\/p>\n\n\n\n<p>Although the <a rel=\"noreferrer noopener\" href=\"https:\/\/laws-lois.justice.gc.ca\/eng\/acts\/C-46\/page-45.html#h-121176\" target=\"_blank\">Criminal Code<\/a> uses the standard definition of genocide as \u201cacts committed with intent to destroy in whole or in part any identifiable group,\u201d there is no longer any consensus \u2014 within government or society \u2014 on what the term \u201cgenocide\u201d actually means. This could have profound implications for how the online harms act is enforced.<\/p>\n\n\n\n<p>Even the strict legal definition could be muddied by the fact that Trudeau <a rel=\"noreferrer noopener\" href=\"https:\/\/www.ctvnews.ca\/canada\/trudeau-s-acknowledgment-of-indigenous-genocide-could-have-legal-impacts-experts-1.5457668\" target=\"_blank\">accepted the conclusions<\/a> of the National Inquiry into Missing and Murdered Indigenous Women and Girls, \u201cincluding that what happened amounts to genocide\u201d \u2014 even though what took place doesn\u2019t meet the legal definition of genocide.<\/p>\n\n\n\n<p>As law professor Bruno Gelinas-Faucher told The Canadian Press in 2021, \u201cA court could say \u2026 that the state has accepted responsibility under international law for the crime of genocide\u201d \u2014 which is \u201ca big deal.\u201d<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Even though prosecuting and enforcing penalties for the crime of promoting genocide would be left to the courts, vindictive users looking to punish those whose views they disagree with will be empowered to flag content, which websites will then have a responsibility to investigate (and possibly incentivized to censor in order to look as though they\u2019re complying with the spirit of the law), and to submit frivolous complaints with the Human Rights Commission.<\/p>\n\n\n\n<p>Do we trust the ideologues working for the HRC or the left-wing activists churned out by universities and scooped up by tech companies to determine whether any given social media post or online video meets the strict legal definition of promoting genocide? How could we, given that the term has been so watered down, no one seems to agree on what it means anymore?<\/p>\n\n\n\n<p>Since Hamas\u2019s Oct. 7 massacre, Jews and other supporters of Israel have been claiming that protesters chanting \u201cfrom the river to the sea\u201d are advocating genocide because a Palestinian state from the Jordan River to the Mediterranean would necessitate the destruction of the Jewish state.
