Starting with a tiny,  apparently in-significant incident.\u00a0 My technique, is = bundle-up your  complaint so someone who knows nothing about it can grasp it, then put  it in front of someone who can do something about it.<br><\/p>\n\n\n\n<p>I  am no fan of the BC Human Rights Commission. Yet it is a proper  starting-point up the ladder of Court &#8230; getting a ruling on the  legitimacy of Commissar Farnsworth&#8217;s\u00a0 &#8220;mandate&#8221; for\u00a0 muzzling British  Columbians = particularly, the exemption which is expressly set out in  his Ministerial Order.\u00a0 <\/p>\n\n\n\n<p><strong>Gordon S Watson<br>Justice Critic, Party of Citizens Who Have Decided To Think for Ourselves &amp; Be Our Own Politicians<\/strong><br>&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>December 1<sup>st<\/sup>&nbsp; 2020<\/p>\n\n\n\n<p>&nbsp;British Columbia Human Rights Commission<\/p>\n\n\n\n<p>This\nis my complaint that on November 30<sup>th<\/sup> 2020&nbsp; employees of the Fountain Diner restaurant in Langford\nBritish Columbia unreasonably denied me a service normally available to the\npublic,&nbsp;&nbsp; contrary to the BC\nHuman Rights Code.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/p>\n\n\n\n<p>01 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; since\nabout June 2020, I have been paying attention to the issue of the imposition of\nregulations under the <strong><em>Emergency Program Act&nbsp; <\/em><\/strong>and also<strong><em>&nbsp;\nPublic Health Act<\/em><\/strong> . In August 2020, <br>\nI received from the office of the Ombudsman a copy of his report&nbsp;&nbsp; \u201cExtraordinary Times\nExtraordinary Measures\u201d.&nbsp; That\nreport is available at the URL on the internet website URL <\/p>\n\n\n\n<p><a href=\"https:\/\/bcombudsperson.ca\/investigative_report\/extraordinary-times-extraordinary-measures\/\">https:\/\/bcombudsperson.ca\/investigative_report\/extraordinary-times-extraordinary-measures\/<\/a><\/p>\n\n\n\n<p>Over-simplified, the opinion of lawyer Jay Chalke, is\n:&nbsp; the administration which had\nbeen in power prior to the election of 2020,&nbsp; exceeded its authority, so that powers it presumed to\nenshrine in law, are un-constitutional ab initio.&nbsp; UN-learned in the law as I am, I say that &gt; <br>\nOrders predicated in those Acts, made consequent to illegal amendments to them,\nare each invalid.&nbsp;&nbsp;&nbsp;&nbsp;\nParticularly:&nbsp; the diktat of\nCommissar Farnsworth re compulsory wearing of face coverings = Ministerial\nOrder M425 made November 24 2020 =&nbsp;&nbsp;\nis of no force nor effect. <br>\nA copy of that order is enclosed as Item&nbsp;\nONE&nbsp; of Materials to be\nrelied-upon<br>\n&nbsp;<br>\n02 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; in\nthe fall of 2020, I began requesting copies of the Orders made by Chief Medical\nHealth Officer Henry as they were advertised in the newsmedia.&nbsp; Each time I called the main office of\nthe Ministry of Health, asking for a hard copy of the most recent Order, I was\ntold \u201cit\u2019s not available\u201d. Then about a week later, it would be posted on the\ninternet.&nbsp; Point being : in the\nmeantime, lacking proper NOTICE, the Chief Medical Health Officer had not\ncomplied with that Act ergo her Order was not in effect in that timeframe<\/p>\n\n\n\n<p>03 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; After\nstudying this topic for the last few months, my position today is =&nbsp; the Covid 19 phenomenon is a HOAX of\nthe first order.&nbsp; It is the worst\nmedical mistake in modern history.&nbsp;\nIncluded as Item TWO and integral to this my complaint, is the\ntranscript of remarks made by Dr Roger Hodkins buttressing my opinion.&nbsp; Also : Item THREE of Materials to be\nrelied upon is the article by the past president of the Ontario Medical\nAssociation <strong>Mask Laws Necessary or Nonsense?<\/strong>&nbsp; <br>\n<br>\n04&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Item\nFOUR of Materials to be relied upon, is, a batch of pertinent pages from the\nKaplan Report. It is crucial that the Human Rights Commission know and take in\nto consideration, that in her official capacity as a health officer in British\nColumbia Bonnie Henry md gave evidence to the Kaplan Commission re the efficacy\nof wearing masks to prevent transmission of contagious disease in hospital\nsettings.&nbsp; I have good reason to\nbelieve and I verily do believe, that in the labor arbitration carried on\nbetween the BC Nurses Union and the Health Sciences Association re the issue of\nwhether or not nurses were compelled to wear masks in hospital settings&nbsp;&nbsp; Bonnie Henry in her capacity\nas Chief Medical Health Officer for British Columbia signed a Memorandum of\nUnderstanding in which she acknowledged that the wearing of masks was irrelvant\nto transmission of contagious disease, particularly, the influenza virus. The\nlabor arbitration was settled behind closed doors, in December 2019.&nbsp;&nbsp; That Memorandum is now improperly\nhidden from the public.&nbsp;&nbsp;&nbsp;\nIt is crucial for the purpose of this my complaint against the Fountain\nDiner that the Human Rights Commission compel Dr Henry to produce that\nMemorandum of Understanding \u2013 or whatever that document is titled &#8211; as evidence\nin this my complaint.&nbsp; <br>\n<br>\n<\/p>\n\n\n\n<p>05&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Also&nbsp; Item FIVE of the Materials to be relied\nupon, the interview <strong>COVID-19: Americans are in \u2018delusional psychosis\u2019.<\/strong>&nbsp;&nbsp;&nbsp; It is crucial that the Human Rights Tribunal\nappreciate that section 103 of the <strong><em>Public Health Act<\/em><\/strong>&nbsp; RSBC provides for a categorical defence to a prosecution under it, if the\naccused had a sincere belief as to the veracity a certain set of facts.&nbsp;&nbsp;&nbsp;&nbsp; <\/p>\n\n\n\n<p>06&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; On\nor about September 2020,&nbsp; in my\ninvestigation of the Corona Madness,&nbsp;\nI came upon the letter of the Vancouver Coastal Health Authority,&nbsp; informing Translink as to the legality\nof compulsion to wear the face muzzle. A copy of that letter is Item SIX of the\nMaterials to be relied-upon.&nbsp;&nbsp;&nbsp;&nbsp; When I learned about the exemption card\noffered by Translink,&nbsp; I\nimmediately published that image around the internet, and handed it to people\nwhom I encountered in what we used to call \u201cthe real world\u201d, recommending that\nthey get it and use.&nbsp; Dozens of\npeople went to the Translink offices and got the card, for free, or printed it\nout from my email message. Feedback I got from them tells me that Translink\ndrivers do acknowledge that that card is valid for the sake of exempting the\nbearer from wearing a muzzle. It is important that the Human Rights Commission\nappreciate that that policy was in effect on November 30<sup>th<\/sup> 2020, the\nday I was denied entry to Fountain Diner.&nbsp;&nbsp; Around that same time, I came upon the image of a card\nwhich declares that the person using it is exempt from compulsion to wear a\n\u201cmask\u201d.&nbsp; A photocopy of the\nfront and back of that card is Item&nbsp;\nSEVEN&nbsp; of the Materials to\nbe relied upon.&nbsp;&nbsp;&nbsp;&nbsp;\nIronically, when I came back home to compose this complaint, I saw a bus\ngo by in which the driver was NOT wearing a muzzle.&nbsp;&nbsp; Shocking, eh? !<\/p>\n\n\n\n<p>07&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; For\ncontext, it is worth noting the following anecdotes.&nbsp; On Monday November 23<sup>rd<\/sup> 2020 I was in Vancouver\nat work in the STAPLES store on Seymour street downtown. The manager of the\nstore came about 20 feet from me and politely said \u201c<em>sir you have to have a\nmask on<\/em>\u201d.&nbsp; I said to him \u201c<em>I\u2019ve\ngot the exemption card\u201d.<\/em> He was happy with that and left. &nbsp;He did not ask to see the card\nitself.&nbsp; Shortly thereafter, I\nattended the Registry of the Lawcourts building at 800 Smithe Street.&nbsp; At the entrance, I was challenged by a\ndeputy Sherriff.&nbsp; I showed him the\nexemption card.&nbsp; He glanced at it\nbut did not read it.&nbsp; He went\nthrough the protocol questions with me, then directed me to go ahead and\nenter.&nbsp; I filed a document with the\nRegistry Clerk, then left the premises.&nbsp;&nbsp;&nbsp; In Vancouver and in Burnaby and in Surrey, I\nentered several other businesses including restaurants. When they politely\nasked me to put on a mask, I showed them the card and had no problem. With one\nexception.&nbsp; In that instance, I\nsimply ignored the fool who refused to acknowledge the declaration,&nbsp; continued to finish what I was doing \u2013\nphotocopying \u2013 then left the premises. On Wednesday November 25<sup>th<\/sup>\n2020 I came back to Swartz Bay on the ferry and had no problem with the staff\nas I walked around, breathing freely un-muzzled.&nbsp;&nbsp; Despite relentless annoying messages over the public\naddress system about requirement to wear a mask, no one challenged me anywhere\non the ship. <br>\n<br>\n08 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; On\nthe morning of November 26<sup>th<\/sup> 2020, at approximately 10:30 am, I\ncalled the head office of the Ministry de Health :&nbsp; 250 952 1330 identified myself and told the telephone\nreceptionist that the <strong><em>Public Health Act<\/em><\/strong> Order of which I\u2019d heard\nrumors, was not available on the website of the office of the Chief medical\nHealth Officer. Recognizing my voice from the other times I\u2019d called asking for\na copy of Orders which were pretended to be in force as of those days yet not\navailable, she said \u201c<em>we\u2019ve had this converstation before.\u201d<\/em>&nbsp; I demanded her name and position. She\nsaid \u201c<em>Angela patient client relations<\/em>\u201d<br>\n<br>\n<\/p>\n\n\n\n<p>09&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The\n<strong><em>Public Health Act<\/em><\/strong> RSBC\ndictates that a person subject to an order must be notified of that Order.&nbsp; I told \u201cAngela\u201d that I required a hard\ncopy of that Order so that I could originate a Request for Reconsideration\npursuant to its section 43 as I had done twice before. In both instances, there\nhas been no reply from the Chief Medical health Officer nor anyone else in her\nMinistry. Even though in that exchange,&nbsp;\nI offered to drive downtown and pick up a copy were they to make it\navailable Angela told me that there was no Order available via the internet nor\nanywhere else.&nbsp;&nbsp; &nbsp;Days later, I learned that the rumor\nabout a \u201cmasking mandate\u201d originated with Ministerial Order in Council M425\nmade \u2013 ostensibly \u2013 under the <strong><em>Emergency Program Act<\/em><\/strong>.&nbsp; Thus,&nbsp;&nbsp; the receptionist, in charge of advising the public\nwhat was going on for all things to do with the Ministry de Health was in\nignorance about the state of the law<\/p>\n\n\n\n<p>10 &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; On\nFriday November 27<sup>th<\/sup>&nbsp;\n2020 I went in to Langford.&nbsp;\nUN-muzzled, I went in to the place where I do banking.&nbsp;&nbsp;&nbsp; No one said a word to me\nabout anything to do with a mask.&nbsp;\nI then went to the Canada Post outlet in the Westshore Town Centre\nmall.&nbsp;&nbsp;&nbsp; After noticing\nthe headline on the Times-Colonist newspaper, I purchased a copy in the\nFairways store.&nbsp;&nbsp;&nbsp;&nbsp;\nNo one there said anything to me about not being muzzled.&nbsp;&nbsp;&nbsp; Reading the frontpage\narticle headed <strong>At odds over whether doctor\u2019s note required to not wear mask\n: <\/strong>item EIGHT of Materials to be relied upon<strong>, <\/strong>I noticed the quotation\nfrom the Emergency Management BC.&nbsp;\nIn the Canadian Journalism style manual,&nbsp; such double quotation marks indicate that that is precisely\nwhat was said.&nbsp;&nbsp; I went over\nto the STAPLES store on McCallum Road.&nbsp;&nbsp; No one there said a word about me not wearing a\nmuzzle, because I am a regular customer and have shown the exemption card to\nmost of the employees, over the past couple of months.&nbsp;&nbsp;&nbsp;&nbsp; I cut the article out\nof the newspaper and fitted it on one sheet then made many photocopies. My\nintent was,&nbsp; to hand them out, for\nfree, to people with whom I might come in contact so as to prompt discussion\nabout the facts and logic to do with government policy to do with the so-called\n\u201cpandemic\u201d.&nbsp; <\/p>\n\n\n\n<p>11&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; On\nMonday November 30<sup>th<\/sup> 2020 I went up to the door of the Fountain\nDiner at&nbsp; 102- 2800 Goldstream Avenue Langford British Columbia.&nbsp; I went inside the door and spoke to a\nwaitress.&nbsp; I gave her my name to\nput on the list of customers waiting to get in.&nbsp; The look she gave me conveyed that she was unhappy that I\nwas not wearing a muzzle.&nbsp;&nbsp;\nAbout 10 minutes later, she came out and called my name. When I stepped\nup as though I would enter, she impeded me.&nbsp; She said&nbsp; \u201cyou\nhave to wear a mask\u201d.&nbsp; I had in my\nleft hand quite obviously, the exemption card.&nbsp; Politely,&nbsp; I put\nit closer to her face so she could get a good look.&nbsp; She glanced at it but did not read it.&nbsp; She said something like \u2018<em>it isn\u2019t\nfrom a government office\u2019<\/em>.&nbsp; I\nsaid to her&nbsp; \u2018<em>read it.&nbsp; The Human Rights commission is a\ngovernment body<\/em>.\u2019&nbsp; She turned\naway saying she would get the manager.<br>\n<br>\n12&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; A\nfew minutes later, another woman walked up to me saying she was the manager.&nbsp; She spoke but it was hard to understand\nwhat she said through the cloth diaper she was wearing over her mouth.&nbsp;&nbsp;&nbsp; After another try, I\ngathered her name was \u201cCrystal\u201d.&nbsp;\nShe told me she was refusing me entry because I did not have on a face\nmask.&nbsp;&nbsp; I held out the\nexemption card for her to inspect. She sneered at it.&nbsp; I pointed to the explanation on the back. She refused to\nread it.
