U.S. JEWISH LOBBY SETBACK AS STATE ANTI-BDS, LAW STRUCK DOWN AS UNCONSTITUTIONAL<\/span><\/h1>\n

THE JEWISH LOBBY in America has suffered an important setback in their attempts to stifle criticism of Israel with the striking down by a US federal judge of the \u201canti-boycott, divestment and sanctions\u201d (BDS) law in Texas, on the grounds that it violates freedom of speech under the country\u2019s first amendment of the constitution.<\/h1>\n

The Texas law \u2014 which has been copied by twenty-five other equally Jewish lobby controlled states in other parts of the country, is officially known as the Anti-Boycott, Divestment and Sanctions law (Anti-BDS) and was passed and signed into law in\u00a0May 2017.<\/p>\n

The law requiring all government contractors to sign a pledge vowing not to participate in the pro-Palestinian BDS movement. At the time that the law was passed, Texas Governor Greg Abbott said that \u201cAnti-Israel policies are anti-Texas policies, and we will not tolerate such actions against an important ally.\u201d<\/p>\n

The blatantly unconstitutional law was challenged by the Council of American-Islamic Relations (CAIR), which sued the state to get the law overturned after a Muslim speech pathologist, Bahia Amawi, was not allowed to sign a contract extension with Pflugerville independent school district \u2014 a public school district near the state\u2019s capital Austin \u2014 unless she pledged to not boycott Israel.<\/p>\n

In his\u00a056-page opinion, Judge Robert Pitman of the Western District of Texas ruled<\/a>\u00a0the state\u2019s law violated the First Amendment by threatening to \u201csuppress unpopular ideas\u201d and \u201cmanipulate the public debate through coercion.\u201d<\/p>\n

The court found that \u201cpolitical boycotts are protected speech,\u201d and \u201cnone of the exceptions to that rule urged by the State apply to this case. The Court therefore concludes that Plaintiffs\u2019 BDS boycotts are speech protected by the First Amendment.\u201d<\/p>\n

In addition, the court ruled that the state of Texas \u201chas failed to identify a compelling state interest justifying H.B. 89\u2019s burden on protected speech.<\/p>\n

\u201cIn fact the only interest distinctly served by the content [and viewpoint] limitation is that of displaying [Texas\u2019s] special hostility toward the particular biases thus singled out. That is precisely what the First Amendment forbids.\u201d<\/p>\n

For this reason alone, the court said, the law is an \u201cunconstitutional content- and viewpoint-based restriction on speech.\u201d<\/p>\n

In a statement released by CAIR after the ruling, that organization said<\/a>\u00a0that \u201cevery single \u2018No Boycott of Israel\u2019 clause in every single state contract in Texas\u201d has \u201c been stricken as unconstitutional,\u201d and that the \u201cAttorney General of Texas is no longer permitted to include or enforce \u2018No Boycott of Israel\u2019 clauses in any state contract.\u201d<\/p>\n

CAIR added that they are \u201cgearing up for the fights in the other 26\u00a0states where anti-BDS laws have been passed and we are certain that we are on the right side of the constitution and history.\u201d<\/p>\n

* It is ironic that increased Muslim immigration into America \u2014 which is the primary cause of the spread of the BDS movement in that country \u2014 is one of the non-White invasions which is specifically supported and encouraged by the Jewish lobby.<\/p>\n

A report in the\u00a0<\/a>Times of Israel<\/a><\/em>\u00a0from December 2015, for example, said that \u201cAmerican Jewish groups,\u201d<\/a>\u00a0including the ADL, the American Jewish Committee, the Religious Action Center of Reform Judaism, the Interfaith Alliance, and others, all announced their vehement opposition to then presidential candidate Donald Trump\u2019s suggestions that Muslim immigration into the US be halted.<\/p>\n

ADL CEO Jonathan Greenblatt called Trump\u2019s plan \u201cunacceptable and antithetical to American values,\u201d while the American Jewish Committee\u2019s Associate Executive Director for Policy Jason Isaacson condemned \u201cin the strongest terms\u201d what it called the \u201clatest offensive and inflammatory comments from Republican presidential candidate Donald Trump.\u201d<\/p>\n

Rabbi Jonah Dov Pesner, Director of the Religious Action Center of Reform Judaism, said in a statement it also condemned Trump\u2019s remarks, as \u201cour nation, founded by those fleeing religious persecution, is rooted in principles of religious freedom.\u201d<\/p>\n

Rabbi Jack Moline, director of the Interfaith Alliance issued a statement saying that \u201ca country that discriminates against individuals on the basis of their faith would be a poor excuse for America.\u201d<\/p>\n
